Welcome to Speak Up Studio. Before enrolling your child to participate in any of our Programs, please take the time to read the following Rules, Terms and Conditions of enrolment.

Once you have read the below, you will be directed to select a checkbox to confirm your agreement to the Rules, Terms and Conditions contained herein. By clicking the buttons at the bottom of the page, or authorising a Speak Up representative to do so on your behalf, “I acknowledge and agree to the Rules Terms & Conditions”, “I acknowledge and agree to all policies”, “I acknowledge and agree to the Waiver of Liability” and “I acknowledge and agree to the Billing Authorisation”, you are signing an Agreement with Speak Up Studio to which you and your child are bound, until your child’s enrolment is withdrawn or terminated. By selecting the checkboxes referred to above, or authorising a Speak Up representative to do so on your behalf, you agree to having read and understood the below terms and conditioned provided herein.

We recommend that you obtain independent legal advice in the event that you require any clarification with respect to the below terms, or alternatively, please don’t hesitate to contact the Studio, as we are more than happy to assist you with any questions or queries you may have with respect to your child’s enrolment with us.

SPEAK UP STUDIO PROGRAMS

Speak Up Studio’s programs run over the four Queensland State School terms, as set by the Department of Education and Training. Each program runs for eight weeks per term, and lessons generally commence in the second week terms. For more information on Speak Up Studio’s term dates, please refer to the Important Dates page on our website.

MEMBERSHIP FEES AND PAYMENTS

The total cost of enrolling your child in a Speak Up Studio program per term is split into three all-inclusive monthly payments. If a child attends classes for a full year (all four school terms) you are required to make twelve separate all-inclusive monthly payments. The monthly payment fee is set out on our website under the Speech and Drama section, and differs depending on the program and age group in which you have enrolled your child for.

When you enrol your child to participate in a Speak Up Studio program, you are enrolling your child to participate in the program for the whole term, and are committing to making all three payments.

Please note, that Speak Up Studio no longer charges additional fees for performances, uniforms, exams, eisteddfods, events, costumes, insurances, registrations, or resources. All of these are included in your Speak Up all-inclusive monthly membership, and families are encouraged to take part in all of the Speak Up Studio events and performing opportunities throughout the year.

The monthly payment is deducted from your nominated credit card/ bank account each month. Generally, monthly payments will be debited on the 15th of each month (“the Charge Date”), however, Speak Up Studio reserves the right to vary the Charge Date at any time.

Even if your child does not attend all classes, you agree to pay the total term cost. You are encouraged to take advantage of our Flexible Make Up Class policy, with respect to any classes your child might miss.

Enrolment in our classes is by term, and as such, monthly payments may only be stopped at the end of any school term.

AUTOMATIC RE-ENROLMENT

Re-enrolment from term to term and year to year is an automatic procedure, which has been introduced by Speak Up Studio to reduce unnecessary administration each term, and to avoid any misunderstandings that may lead to a student missing out on a place in their usual class. Most of our students attend for numerous years in a row and many of our classes are full and have waiting lists.

When you enrol your child to participate in a Speak Up Studio program for a particular term, your child’s enrolment will continue for the next term, and the following term, and so forth, until you submit a Withdrawal of Enrolment form, notifying us that you wish to cancel your child’s enrolment. It is therefore very important that you read and consider the below policy with respect to withdrawing your child’s enrolment with our program/s.

WITHDRAWAL & CANCELLATION OF ENROLMENT

Re-enrolment information will be sent out to parents towards the end of each term.

If you wish to cancel your child’s enrolment and you do not wish for your child to participate in our program for the next term, you must fill out our Withdrawal of Enrolment form by the last day of the current Queensland State School term, as set by the Department of Education and Training (“the Withdrawal Cut-off Date”).

If we do not receive a Withdrawal of Enrolment form by the Withdrawal Cut-off Date, your child will be enrolled automatically in one of our programs for the following term and you are bound to pay for the next term’s fees. Your child’s enrolment each term is automatic, and will continue until a Withdrawal of Enrolment  form has been received by us.

If a student withdraws their enrolment before the end of a term, the current full term’s fees will still remain payable.

If you have confirmed your child’s participation in a performance opportunity (such as an exam, concert or eisteddfod) you are obligated to continue with monthly payments until the performance is complete. Extensive performance planning is carried out based on confirmed enrolments.

Speak Up Studio may reschedule or cancel classes at any time. If changes are made that affect your child’s ability to attend classes, Speak Up Studio will refund any outstanding fees within 30 days of receiving notice from you that your child will be unable to attend class as a result of the change in schedule.

Please note that any unpaid fees may result in the student being removed from our programs.

TRIAL LESSON & MONEY-BACK GUARANTEE

Speak Up Studio does not offer trial lessons to new students as we do not believe it is possible for a child to get a full understanding of what our programs are like in just one lesson. In our experience, children take time to get used to a new environment and a new teacher and it can take several lessons for them to find their groove! We consider that it is important to give children time to settle in so that they can truly receive all the benefits Speech and Drama has to offer.

Speak Up Studio do not offer a cooling off period, however, we are incredibly confident that your child will love being a part of Speak Up Studio, and that’s why we offer a 100% money back guarantee within your first month of classes. If your child does not enjoy their class, we will gladly refund your first monthly payment. Our money back guarantee ensures that each child is able to settle into their class and get to know their teacher, much more than they could during a single trial lesson.

We are committed to helping your child settle into their class, so that they may begin to enjoy the wonderful benefits of Speech and Drama. We would appreciate if you can speak with us to let us know any concerns that you have about your child’s participation so that we can make appropriate adjustments to accomodate them, and help them settle in within their first month of classes. If you fail to attend any lessons, or fail to communicate your concerns to your child’s teacher, we may be unable to provide a refund under the terms of this guarantee. Under no circumstances will we provide a refund as a result of change of mind, or for any other reason that is not directly related to the child enjoying his or her class.

Please note, if in the very rare instance that a trial lesson is offered, these are offered on an obligation free basis, rather than as a free class. If the student continues with the program their first class will be included within your all inclusive monthly payment.

FLEXIBLE MAKE UP CLASSES

Speak Up Studio is proud to offer a flexible make-up policy for missed group classes. We are more than happy for students to attend a make-up lesson in an identical class on a different day. It is the responsibility of the parent to identify the alternate class from our timetable (for example, a student who missed an Explorers lesson on Monday, may attend an Explorers lesson on Wednesday instead) and to email the studio to request a make-up lesson, we will let you know if we can accomodate your request.

Please note, make-up lessons are limited to two per student per term.

Make up lessons are not available for missed individual classes or workshops, however, it is considerate to let the teacher know if your child is unable to attend their individual lesson or workshop.

SAFETY

We are committed to ensuring the safety and wellbeing of all children and young people and will endeavour to provide a safe and supportive environment for children and young people by:

  • treating our students with respect, understanding and by addressing their concerns as soon they arise
  • ensuring that all of our staff and volunteers hold current Blue Cards
  • enforcing a strict code of conduct for all of the Speak Up Studio community
  • providing clear dispute resolution mechanisms
  • making our child and youth risk management strategy available to all members of the Speak Up Studio community,
  • ensuring that our programs are engaging and age-appropriate for students
  • limiting the size of our programs, to ensure that teacher to student ratios are appropriate
  • creating an inclusive environment within our studio
  • creating a positive and supportive teaching program that encourages the emotional and social development of our students, and 
  • providing a high level of ongoing support and training to our teachers

Unacceptable behaviour and/or language will not be tolerated. Speak Up Studio reserves the right to refuse any student or parent that present a disciplinary problem to staff or a threat to the safety and wellbeing of other children or parents. Parents will be notified of inappropriate behaviour or such threat or problem upon Speak Up Studio becoming aware of same on one occasion only, and if unacceptable behaviour persists following such notice,  Speak Up Studio reserves the right to remove the student from the class. In these circumstances, a refund will not be available.

PARENTS’ CODE OF CONDUCT

By enrolling your child with Speak Up Studio, you agree to be bound by the Parents’ Code of Conduct. Parents have a responsibility to:

  • drop off and pick up children in a timely manner
  • alert Speak Up Studio of any concerns as soon as they arise
  • encourage your child to follow Speak Up Studio’s rules, and to work hard in class
  • never ridicule your child for making a mistake
  • respect decisions made by Speak Up Studio staff, especially with regard to script selection and casting
  • not force your child to participate in Speak Up Studio’s programs
  • take an interest in your child’s learning, and
  • respond to communication from the studio in a timely manner

Parents have the right to:

  • receive feedback on a student’s progress
  • ask questions or raise concerns about Speak Up Studio’s programs, or student progress, and
  • have personal information treated confidentially, so that privacy is respected.
STUDENT CODE OF CONDUCT

Students have a responsibility to:

  • demonstrate a willingness to learn and participate in Speak Up Studio’s programs
  • behave appropriately, using acceptable language at all times
  • treat other students as they would like to be treated
  • report inappropriate behaviour, unsafe situations and harm, and
  • participate for their enjoyment and not just to appease their parents

Students have the right to:

  • feel safe, respected and understood
  • be included regardless of abilities
  • be listened to and to be able to ask questions if they don’t understand something
  • be involved in decisions that affect them
  • have their best interests considered, and
  • be free from harassment, bullying or abuse of any kind
WORKSHOPS

Speak Up Studio also offers workshops during the school holidays. Please refer to the School Holidays section on our website for more information.

Payment for workshops is required at the time of enrolling. If payment is not received at the time of enrolling, the enrolment will be cancelled. Workshop bookings are non-transferable and non-refundable. If the student’s availability changes, it may be possible to switch into a similar workshop on a different day, at the discretion of Speak Up Studio.

If scheduling changes are made by Speak Up Studio that affect any participant’s ability to attend a workshop, Speak Up Studio may offer a place in an alternate workshop. If an alternate workshop place cannot be agreed upon or arranged, Speak Up Studio will refund any fees you paid for the workshop within 30 days.

LATE COLLECTION FEES

Our teachers will not leave children unattended, and are paid by the hour. If parents are late to pick up their children after drama class, a late fee (per child) will apply:

  • 10 – 15 minutes late: late fee is $11
  • 15 – 30 minutes late: late fee is $22
  • 31 – 60 minutes late: late fee is $44
  • Over 1 hour late: late fee is $55 and student’s enrolment may be terminated.

Late fees will be automatically debited from your credit card via the Parent Portal within 30 days of the instance of late collection. You will be notified before your credit card is charged.

BIRTHDAY PARTIES

A non-refundable deposit of $100.00 is payable at the time of booking your child’s birthday party to confirm the booking.

Full payment for the total cost of the party must be received on or before the day of the party, via the Parent Portal.

A standard birthday party caters for up to twelve children only. Any additional children will incur a fee of $20.00 per additional child. If additional, unexpected children turn up on the day (including siblings of children attending the party) we will not stop them from participating, however, an additional tax invoice will be sent to you for the additional children, which will be payable within seven days thereto.

If you cancel the party within one weeks of the scheduled party date, the full party fee remains payable. If you cancel your child’s party by providing us with more than one week’s written notice prior to the scheduled party date, your $100.00 deposit will be forfeited, however, you will not be charged for the full party fee. 

An alternate cancellation policy may be considered in extreme circumstances on an individual case by case basis and at the sole discretion of Speak Up Studio.

As we often photograph our beautiful parties, it is important that parents and caregivers are aware that their children may be filmed or photographed while participating in Speak Up Studio parties. It is the responsibility of the parent or caregiver paying for the party to communicate this to parents or caregivers of children attending the party.

If scheduling changes are made by Speak Up Studio that affect your birthday party booking, we may offer an alternate day for the booking. If an alternate day cannot be agreed upon or arranged, Speak Up Studio will refund any fees you paid for the birthday party within 30 days.

TERMINATION OF ENROLMENT

You agree that in the event of a missed payment by you that is subsisting for more than 14 days, Speak Up Studio may terminate your child’s enrolment with our program/s. If Speak Up Studio terminate your child’s enrolment during any term, the full term’s fees will still be due and payable by you.

PRIVACY POLICY

Speak Up Studio is committed to safeguarding your privacy. The Privacy Act 1998 (Cth) governs the ways in which we must manage you and your child’s personal information.

When enrolling, enquiring or registering, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information, Information about your child or other details will be used to help you with your experience at Speak Up Studio.

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

  • To provide feedback about how your child is progressing
  • To provide updates about events that your child is invited to participate in
  • To allow us to better service you in responding to your customer service requests
  • To quickly process your transactions
  • To send periodic emails regarding your order or other products and services
  • To follow up with you after correspondence (live chat, email or phone inquiries)
DISCLAIMER

You acknowledge that Speak Up Studio have used their best endeavours to ensure that the information contained herein is true and accurate but you acknowledge and agree that Speak Up Studio accepts no responsibility and disclaims all liability in the event of any error, misrepresentation or inaccuracy of such information.

You acknowledge having made your own enquiries with respect to the information contained herein prior to agreeing to be bound by these rules, terms and conditions. 

WAIVER OF LIABILITY

PERSONAL INJURY/PROPERTY DAMAGE INDEMNITY

You warrant that your child is medically sound to undertake and participate in classes at Speak Up Studio. You hereby give consent for your child to participate in any and all programs and activities and you accept all risks associated with participation in our classes, workshops, or activities.

In consideration for your child’s participation, you agree that your child attends class at your sole risk and responsibility and you agree to indemnify Speak Up Studio and its employees, contractors, directors, volunteers and representatives from any liability, loss or damage or any other claim associated with the attendance of your child at Speak Up Studio classes, workshops or activities. 

You agree to hold harmless, waive and release Speak Up Studio and its employees, contractors, directors, volunteers and representatives from liability as a result of personal injury or property damage occurring while your child are in attendance at a Speak Up Studio class, workshop or activity.

You agree that Speak Up Studio’ liability to you or any third party for any indirect or consequential loss, injury or damage suffered by you or your child, howsoever caused, as a result of any negligence, misrepresentation or otherwise, it limited to the amount of consideration paid by you for the services provided under this Agreement.

MEDIA INDEMNITY

Children may be filmed or photographed while participating in classes or studio activities. This material may be published in Speak Up Studio printed publications and online (including on the Speak Up Studio website and Facebook page.) Images may also be supplied to third parties (eg. Local newspapers) for promotional purposes. Speak Up Studio has comprehensive policies on the use of images of children.

If you do not wish your child to be filmed or photographed or used in publications or for media purposes, you must advise Speak Up Studio in writing prior to your child’s first class.

EMERGENCY MEDICAL TREATMENT INDEMNITY 

In the event of an accident or emergency, you hereby authorise and grant permission for Speak Up Studio and its employees, contractors, directors, volunteers and representatives to take whatever action may be necessary in the event of an emergency in the event that you or your child’s emergency contact person cannot be contacted, and you release and hold Speak Up Studio and its employees, contractors, directors, volunteers and representatives harmless in connection with any such action taken or for any omission made by Speak Up Studio.

Additionally, you hereby agree to indemnify Speak Up Studio for all medical expenses which may be incurred by Speak Up Studio as a result of an injury sustained by your child while participating in a Speak Up Studio class, workshop or other activity.

DISCLAIMER

You acknowledge that Speak Up Studio have used their best endeavours to ensure that the information contained herein is true and accurate but you acknowledge and agree that Speak Up Studio accepts no responsibility and disclaims all liability in the event of any error, misrepresentation or inaccuracy of such information. You acknowledge having made your own enquiries with respect to the information contained herein prior to agreeing to be bound by the Waiver of Liability.

BLLING AUTHORISATION

AKCNOWELDGEMENT AND WARRANTIES

You acknowledge and agree that:-

  • Enrolment between terms and years is an automatic procedure and your child will be enrolled in the next term automatically unless Withdrawal of Enrolment form has been submitted by the Withdrawal Cut-off Date (refer to the Terms and Conditions section);

  • If you miss the Withdrawal Cut-off Date, billing will continue into the following term;
  • Re-enrolment information will be sent out towards the end of each term;
  • your credit card will be charged monthly until such time as your child’s enrolment is terminated, withdrawn or cancelled in accordance with Speak Up Studio’s Terms and Conditions;
  • If you withdraw your child’s enrolment during the term, the full term’s fees are still payable;
  • You are responsible for the monthly payment whether or not your child attends class or not;
  • Any unpaid fees may result in your child being removed from our programs;
  • Should you dispute a debit made by Speak Up Studio through your financial institution, this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services provided by Speak Up Studio.

You warrant that:-

  • The credit card details you have supplied are true and correct;
  • Any charges incurred by you will be honoured by your credit card company or financial institution; and
  • You will advise Speak Up Studio in writing immediately if there is a change to your credit card details.
AUTOPPAY AUTHORISATION

The total cost of enrolling your child in a Speak Up Studio program per term is split into three all-inclusive monthly payments. When you enrol your child to participate in a Speak Up Studio program, you are enrolling your child to participate in the program for the whole term, and are committing to making all three payments.

You hereby authorise Speak Up Studio via this facility to:

  1. automatically debit your nominated  credit card or bank account on the Charge Date (as varied) each month for the services provided, including any late pick up fees charged by Speak Up Studio to you; and
  2. continue to debit your nominated credit card/bank account each month until such time as your child’s enrolment with Speak Up Studio is terminated or withdrawn, in accordance with the Terms and Conditions.

You understand that a Withdrawal of Enrolment form is required to terminate billing, and you are responsible for payment whether or not your child attends classes.

LATE PAYMENT FEES/ DEFAULT INTEREST

In the event that a debit is dishonoured, or you fail to pay any amount due and owing to Speak Up Studio by the due date, you agree to pay Default Interest to Speak Up Studio at 15% per annum for each day that the payment is overdue.

In the event that a payment due and owing to Speak Up Studio remains outstanding for a period of 30 days, Speak Up Studio  may commence legal proceedings against you for recovery of the debt. 

You agree to  indemnify Speak Up Studio against any legal fees (on a client and solicitor basis) incurred by the Speak Up Studio in recovering payment of the debt from you, including any interest payable on the debt.
